Abstract:
This study examines the standards of international law pertaining to the use of administrative detention in a state of emergency. More specifically, the study examines the criteria used in a particular state of exception - primarily, the state of belligerent occupation. This is because the legal standards applicable to this special state of emergency detail conditions for the use of the measure in occupied territories.
