Abstract:
This chapter looks at the gaps in the law regarding the detention of terror suspects outside a state's territory, which is not subject to an appropriate legal framework. The author uses the example of the conflict against ISIS to demonstrate that, although there has been some convergence in views between the United States and European countries, there is still much work to be done to reach agreement. According to him, governments and international lawyers should seize that opportunity and begin working toward a much-needed legal framework for the detention of terror suspects captured outside a state’s territory.
