This chapter aims to demonstrate that the right to return home and the right to property restitution are well established under conventional as well as customary international law and that such rights, which extend to situations of mass displacement, are not dependent on nationality. It discusses how these rights are protected under both international humanitarian law and international human rights law, and how these two fields of law interrelates in that domain.
