Abstract:
This book was conceived to assist the work of the ICRC Regional Delegation for South Asia in its efforts in both IHL dissemination and in encouragement of national implementation of IHL in the region. The core of the book, therefore, is the text of IHL treaties that are open for accession by States. In addition to treaty law, the list of customary IHL rules published by the ICRC in 2005 appears, as do recommendations on the interpretation of the notion of 'direct participation of hostilities' adopted by the ICRC in early 2009, as well as the latest version (as the date of publication) of our List of IHL Treaty Accessions. The section on legislation includes the text of the major IHL- related laws adopted in South Asia, and, for national implementation purposes, model legislation published by the ICRC and other organizations which seeks to incorporate these internal obligations into domestic law. Finally, sample cases from the region which have considered IHL treaties are included.
