Modern international humanitarian law has primarily been developed through the adoption of new treaties. However, this development has in no way diminished the relevance and importance of customary humanitarian law. This chapter examines why custom remains relevant today and tries to illustrate this on the basis of actual examples taken from military operations, case law and arbitral proceedings. It also examines legal impediments to the application of international humanitarian treaty law.
