Abstract:
In 2000 the author published an article in the British yearbook of international law reviewing the substantive case-law of the two ad hoc tribunals for the former Yugoslavia and Rwanda in the period from 1995 to 1999. This article updates that review by considering developments in the period from the beginning of 2000 to October 2004. The focus remains the same: the discussion is limited to matters of substantive law to the exclusion of procedural points. This articles deals with the crimes within the jurisdiction of the tribunals, some issues of participation in the commission of crimes, defences, and some other questions of general interest.
