Abstract:
This chapter explores the standard of diligence which should apply in evaluating compliance with the obligations to take precautionary measures, in light of new information technologies, bearing in mind the necessity of a context sensitive appreciation of the capacity of state parties to an armed conflict. While states with the most advanced technological capabilities involved in long term armed conflicts will be the focus of this chapter (utilising the American experience as a case study), the framework of analysis set out in this chapter also responds to the particular circumstances of less developed states.
