Fundamental guarantees in customary international humanitarian law

The subject of the present discussion is rules of humanitarian law related to humane treatment by each belligerent party, with persons belonging to the other party. The speaker reviews some points with regards to Chapter 32 of the ICRC study on Customary International Humanitarian Law on fundamental guarantees. Then, with reference to international practice following the publication of the study, he tries to clarify the attitude of the international community towards rules included in this chapter. He finally points out some concerns regarding compliance with fundamental guarantees.
