Abstract:

Enforced disappearance is prohibited under international humanitarian law both in international armed conflicts and in non-international armed conflicts. Although the four Geneva Conventions and the Additional Protocols do not expressly refer to enforced disappearance, this chapter examines a number of provisions under which the prohibition of enforced disappearance may be subsumed. In addition, numerous measures which have to be undertaken by the belligerent parties serve to prevent acts of enforced disappearance. As a basis for these considerations, the general relation between international humanitarian law and human rights law will be explored.
