Abstract:
Response to an article by Michael J. Dennis and Andre M. Surena in the same Review. The central issue is the extra-territorial application of the International Covenant on Civil and Political Rights and its applicability in armed conflict. The author discusses recent developments in the jurisprudence of the Human Rights Committee and the International Court of Justice in order to highlight his criticisms of Dennis' and Surena's arguments and methodology. A the heart of the discussion is an analysis of appropriate canons of treaty interpretation as applicable in particular to the Covenant.
