The character of the conflict in Gaza : another argument towards abolishing the distinction between international and non-international armed conflicts
The purpose of this article is twofold. It will attempt to address the character of this conflict, in line with the traditional distinction between international and non-international. In this particular conflict, there were differing views due to the status of Hamas, Gaza and the varying interpretations of the relevant legal standards. After examining several options it will become evident that arguments on both the international or non-international character of the conflict could stand. As this is not the first time that there is a considerable difficulty in making the proper classification, the author will further argue in favour of abolishing this dichotomy.
